Our team of estate and probate litigators has extensive experience handling trust and estate litigations ranging from routine will disputes to sophisticated proceedings involving multiple beneficiary levels, claims of financial exploitation, and questions regarding a decedent’s capacity. In any probate dispute that we take on, we strive to provide our clients with high quality representation, and our attorneys have a wide range of experience in state and federal courts, as well as in mediation and other cost-effective dispute resolution alternatives. Our firm represents trustees, businesses large and small, executors and personal representatives, surviving spouses, beneficiaries, non-profits and charities, and other interested parties in a variety of estate litigation matters, including disputes related to:

  • Beneficiary/interested party challenges to wills and trusts
  • Capacity challenges
  • Fiduciary litigation
  • Representing elderly and/or incapacitated clients in claims of financial exploitation and securities fraud
  • Theft by trusted advisors and vulnerable adult claims
  • Disputes over rights to a decedent’s remains
  • Elder law

Some examples of recent disputes handled by our trust and estate litigators include:

  • Successfully defended a large estate against a claim by an estranged daughter who stood to take the entire estate under a contract that prevented her disinheritance. At trial, we proved that the contract had been voided by the subsequent acts of the parties.
  • Represented a group of charitable organizations in a dispute over the distribution of a $25,000,000 estate.
  • Prosecuted claims of fraud, undue influence, exploitation of a vulnerable adult, incapacity, and partial intestacy in connection with a sizeable estate. We successfully represented the siblings of the decedent against the designated beneficiary of the decedent's trust, obtaining a mediated settlement in excess of $1 million on behalf of the decedent's heirs.
